Remote Hearings
The Judges’ Forum of Serbia has successfully implemented the project “Online Trials – Advantages of Remote Hearings,” with the support of the Netherlands Ministry of Foreign Affairs Regional Partnership Fund (NFRP-MATRA).
Glavni problemi srpskog pravosuđa su skupa i dugotrajna suđenja prouzrokovana, između ostalog, i nemogućnošću da se obezbedi prisustvo svih potrebnih lica na suđenjima. Većina država EU ima zakonodavni okvir koji predviđa široke mogućnosti korišćenja interneta u funkcionisanju suda, kao i mogućnost da se vode onlajn suđenja koja utiču na efikasnost i troškove sudskih postupaka. Za razliku od njih, Republika Srbija nema jasnu relevantnu zakonsku regulativu, nema razvijene softverske programe koji bi udovoljili zahtevima za sprovođenje pravnih i odgovarajućih onlajn suđenja i nema profesionalnu inicijativu za promenu trenutne situacije. Imajući u vidu da je trenutna pandemija skrenula pažnju na značaj mogućnosti korišćenja relevantnih programa u sudskim postupcima, smatrali smo da je ovo najpovoljniji trenutak za pokretanje inicijative za promenu važećeg zakonodavstva, odnosno za detaljniju zakonsku regulativu upotrebe takvih softvera u sudskim postupcima, ali i za motivisanje sudija i tužilaca u tom smeru, kao i njihovu obuku o onlajn radu.
Project activities
Within the project, the activities were primarily focused on the preparation of a study containing:
a) data on the current situation in Serbia regarding the applicability of appropriate software for conducting online hearings;
b) analysis of relevant legal provisions;
c) an overview of best practices in comparative countries related to online hearings;
d) results of research on methods for protecting fundamental human rights of all parties in court proceedings during online hearings.
Within the “Remote Hearings” project, a monograph titled “Remote Hearings – Legal Framework and Practice” was published, authored by Professor of the Faculty of Law, University of Belgrade, Dr. Ivana Krstić, Judge and President of the Basic Court in Požega, Dr. Olga Tešović, Judge of the Basic Court in Niš, Ivana Milovanović, as well as Judge of the Basic Court in Novi Sad, Dušan Dakić.
The project is implemented across the entire territory of the Republic of Serbia and primarily involves judges and prosecutors.

The data collected in the analysis, as well as the conclusions from the debates, served as the basis for the implementation of a webinar on remote hearings, which can be accessed at the following link: http://forumsudija.org.rs/sudjenje-na-daljinu. A simple registration is required to access the webinar.
As part of the project, debates were also held on the advantages and disadvantages of remote hearings, as well as an analysis of the domestic and international legal framework and practice.
