The Judges’ Forum of Serbia informed the public about the first proposal to improve the material position of judges in February 2022. The initial proposal concerned judges’ salaries, followed by proposals related to pensions and other aspects of their material status.
Our proposals received support from all employees in the judiciary, as well as a high level of understanding from the general public.
The level of salaries depends on the annual budget (i.e. the discretion of the executive branch, which proposes the budget, and the legislative branch, which adopts it), while the Law on Judges does not provide any guarantees for the stability and adequate level of judges’ salaries.
This is the position of the Venice Commission, which we fully support.
WE PRESENT YOU THE CONSOLIDATED PROPOSALS FOR IMPROVING THE MATERIAL POSITION OF JUDGES
I
The salary base may not be lower than the amount enabling a judge in the first salary group to receive a salary equal to twice the average salary in the Republic of Serbia, according to the latest available monthly statistical data.

If a judge performs judicial duties for more than ten years in a court of the same rank and achieves exceptional work results, they are transferred to the next salary group, on the basis of which their salary is calculated.

For all judges, 12 months of effective work are counted as 16 months of pensionable service.
IV
Each calendar year, a judge is entitled to annual leave of 40 working days.
A judge is entitled to paid leave for attending master’s academic studies, doctoral academic studies, or other relevant academic studies in the country and/or abroad – 5 consecutive working days, up to a maximum of 15 working days.
A judge is entitled to an increase of the basic salary in the amount of 0.5% within the salary group in which they are classified, for each full year of service.
